Terms of Service for Financially Growing LLC
Effective Date: May 31, 2025

We’re all about helping families plant, nurture, and harvest healthy money habits—but the legal soil still has to be tilled. Please read these Terms carefully before using our site, services, or learning materials.

1. Agreement to Terms

By accessing financiallygrowing.com or any related course portals, downloads, coaching sessions, social-media groups, or email content (collectively, the “Services”), you (“you,” “User”) agree to be bound by these Terms of Service (“Terms”) and all applicable laws. If you do not agree, please do not use our Services.

2. Who We Are

Financially Growing LLC (“Financially Growing,” “we,” “us,” or “our”) is a virtual education company registered in Oregon, USA. Our mission is to equip teens, parents, and educators with real-life financial skills—faith-optional, always practical.

3. Eligibility

  • You must be at least 18 years old or the age of majority in your jurisdiction to purchase Services.

  • Teens aged 13–17 may use certain Services only with verifiable parental or guardian consent.

  • We do not knowingly permit children under 13 to create accounts (see Privacy Policy for COPPA details).

4. Accounts & Security

  1. Registration. To access paid or gated content, you may need an account. Provide accurate, complete information and update it if it changes.

  2. Credentials. Keep your username and password confidential. You are responsible for all activity under your account.

  3. Suspension. We may suspend or terminate accounts that violate these Terms or applicable law.

5. Educational Purpose & No Professional Advice

All content is for educational purposes only and does not constitute legal, tax, investment, or accounting advice. Always consult a qualified professional for personalized guidance. Using our Services does not create a fiduciary or client–advisor relationship.

6. Payment, Pricing & Refunds

  • Pricing. All prices are listed in U.S. dollars and may change without prior notice (but not retroactively after you enroll). Taxes and processing fees may apply.

  • Payment Processing. We use PCI-compliant third-party processors (e.g., Stripe, PayPal). We never store full card numbers.

  • Refunds. Unless a specific product page states otherwise, digital products are non-refundable once delivered. Live cohorts and coaching sessions follow the refund policy disclosed at checkout.

  • Chargebacks. Initiating a chargeback without contacting us first may result in account termination.

7. License to Use Our Content

We grant you a limited, non-exclusive, non-transferable, revocable license to access the curriculum, downloads, and resources for your personal, non-commercial use only. You may not reproduce, distribute, sell, or publicly display our materials without written consent.

8. User Content

You may upload comments, assignments, or other content (“User Content”). By doing so, you grant Financially Growing a worldwide, royalty-free license to use, display, and adapt your User Content solely to operate and improve the Services. You represent that you own or have rights to any User Content you submit and that it does not infringe any third-party rights or contain unlawful material.

9. Prohibited Conduct

You agree not to:

  1. Copy, scrape, or reverse-engineer our site or courses.

  2. Share login credentials or course files outside your household or licensed classroom.

  3. Post hateful, harassing, obscene, or illegal content.

  4. Use bots or automated systems to access the Services.

  5. Interfere with servers or networks connected to the Services.

Violation may result in immediate termination without refund.

10. Intellectual Property

All content—videos, PDFs, slide decks, quizzes, logos, trademarks, illustrations, and code—is the exclusive property of Financially Growing or its licensors and protected by U.S. and international IP laws.

11. Third-Party Services & Links

Our site integrates tools like Squarespace, Google Classroom, ConvertKit, and social-media widgets. We are not responsible for their content, policies, or actions. Review their terms separately.

12. Disclaimer of Warranties

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including, but not limited to, merchantability, fitness for a particular purpose, and non-infringement. We cannot guarantee that (a) the Services will be uninterrupted or error-free, or (b) that you will achieve any specific financial outcome.

13. Limitation of Liability

To the fullest extent permitted by law, in no event will Financially Growing, its owners, employees, or partners be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data, goodwill) arising out of or related to your use of the Services—even if we have been advised of the possibility of such damages. Our aggregate liability shall not exceed the greater of (a) $100 or (b) the amount you paid to us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Financially Growing and its affiliates from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Services.

15. Governing Law & Dispute Resolution

  • Governing Law. These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law principles.

  • Informal Resolution. Before filing a claim, contact us at financiallygrowing@gmail.com so we can try to resolve the issue amicably.

  • Arbitration. If we can’t settle informally, disputes (except small-claims actions) will be resolved by binding arbitration in Portland, Oregon, under the rules of the American Arbitration Association. You waive the right to a jury trial and to participate in class actions.

  • Small Claims. Either party may bring an individual claim in small-claims court instead of arbitration.

16. Changes to the Terms

We may update these Terms from time to time. The “Effective Date” at the top tells you when we last revised them. Material changes will be posted on the website and, where legally required, we’ll notify you via email. Continued use after changes means you accept the updated Terms.

17. Termination

We may terminate or suspend your access to the Services at any time for any violation of these Terms, without refund. Sections 5, 7–15, and 18 survive termination.

18. Miscellaneous

  • Entire Agreement. These Terms, the Privacy Policy, and any product-specific notices form the entire agreement between you and us.

  • Severability. If any clause is found unenforceable, the remainder of the Terms stay in effect.

  • Waiver. Our failure to enforce any right is not a waiver.

  • Assignment. You may not assign your rights; we may assign ours in a merger or acquisition.
